The law varies from place to place, without knowing WHERE this happend, you cant get a good answer.
Now in Las Vegas, the law is very clear, anybody not in a crosswalk is taking their life in their hands, if you hit somebody not in a crosswalk, you don';t even get a ticket.
Old codgers going for groceries get killed all the time.

The pedestrian was illegally crossing the road, and is totally at fault here. Your friend DID try to avoid the accident (which IS his responsibility, even if the other guy is being inept) so he should be not found at fault here. Your friend should not be found legally liable.
You stated 5 lane highway. If this were an interstate freeway [ex.I-95 or Interstate 241] your friend is not at fault. Pedestrians are not permitted here. If it were a state highway or local rd, then most likely the pedestrian is guilty of j-walking. This puts your friend not at fault again. Cross-walks are for a reason, and it sounds like the victim should have been using one.
